This Acceptable Use Policy ("AUP") governs your use of Kilo (the "Service"), provided by Nerdy Consultants LLC. This AUP is part of your Terms of Service. Violating it may lead to warning, suspension, or termination.
Kilo is built for contractors. It is a professional tool for a professional trade, and this policy is written from that starting point.
1. No spamming homeowners
The Service includes concierge, reception, and outreach features that can send messages to homeowners on your behalf. When you use those features you must:
- Only contact homeowners you have a legitimate business reason to contact (an existing project, a signed contract, a prior estimate, an inbound inquiry, an in-person conversation, or a lawful cold outreach permitted in your jurisdiction).
- Comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state Do-Not-Call laws, and any equivalent laws that apply to you.
- Honor opt-out requests promptly and permanently — Kilo maintains an opt-out list, but you are responsible for not overriding it.
- Not send bulk messages to purchased lists, scraped lists, or any list of individuals with whom you have no relationship.
- Not spoof, disguise, or misrepresent the sender.
2. No unauthorized claims-negotiation
Kilo operates in a regulated space. You may not use it to violate laws that limit how contractors interact with insurance claims, including:
- Kentucky KRS 367.628, which prohibits a contractor from negotiating insurance claims on a homeowner's behalf or from absorbing or rebating a deductible.
- Equivalent statutes in other states where you operate.
The AI features in Kilo that produce homeowner-facing letters, denial kits, and claim documentation are drafted in the homeowner's voice and are for the homeowner's use. You may not represent Kilo output as your own advocacy of a homeowner's claim, and you may not use it to circumvent laws that require a licensed public adjuster or attorney.
3. Kilo is for your Kilo work only
- Do not use your tenant to store data unrelated to your contracting business (personal photos, unrelated client bases, someone else's data set).
- Do not use the Service to host, distribute, or process content that is illegal, defamatory, obscene, harassing, or infringing.
4. No reselling access
- You may not resell, sublicense, or otherwise transfer access to Kilo to another business.
- You may not share user seats between individuals. Each user must have their own account.
- White-label and reseller arrangements are available only under a separate written agreement with us.
5. No abuse of AI features
- Do not attempt prompt injection, jailbreaking, or other techniques designed to make Kilo's AI produce output outside its intended scope.
- Do not use Kilo's AI to generate content that is illegal, defamatory, discriminatory, sexually explicit, or misleading about a real person.
- Do not use Kilo to impersonate an insurer, adjuster, government agency, or another party.
- Do not use output from Kilo to train a competing AI system.
6. No reverse engineering
- Do not decompile, disassemble, or reverse engineer the Service or attempt to derive its source code.
- Do not probe, scan, or test the Service's vulnerability except through a written security testing agreement with us.
- Do not use scrapers, bots, or automated tools to interact with the Service in a way that is not through documented APIs and reasonable rate limits.
- Do not remove or obscure Kilo's branding, copyright notices, or attributions.
7. No harm to the Service or other customers
- No denial-of-service, flooding, or resource abuse.
- No attempts to bypass authentication, tenant isolation, or rate limits.
- No malware, phishing infrastructure, or exploit hosting.
- No accessing another customer's tenant, data, or users without their consent.
8. Reporting
If you become aware of a violation of this AUP or a security issue in the Service, email [email protected] (for security) or [email protected] (for AUP concerns) and stop the activity immediately.
9. Consequences
Depending on severity and history, we may respond with:
- Warning — a written notice, an opportunity to cure, and any reasonable steps we require you to take.
- Suspension — temporary loss of access to the Service or specific features. Suspensions may be immediate for serious or ongoing violations.
- Termination — permanent loss of access. Termination for AUP violation is not eligible for refund.
We may skip steps in serious cases, including cases involving safety, legal risk to us or other customers, or repeated violations. We may also cooperate with law enforcement where appropriate.
